Site Terms of Use In order to use the platform named Tilky (the "Application"), which belongs to HW Club Danışmanlık Tic. İth. İhr. Ltd Şti. (hereinafter referred to as the "Company"), located at the address Yalıkavak Mah. Atatürk (Yalıkavak) Cad. No: 52/80 Bodrum / Muğla, please read the conditions set forth below By using the Site and Application belonging to the Company, subject to creating an account, in the capacity of a "User" (the website and/or mobile applications shall hereinafter be referred to as the "Channels"), you accept, declare and undertake that you have read these "Terms of Use", that you have fully understood their content, that you accept all matters unconditionally and without reservation, and that you will not raise any objection or defense with respect to all the matters specified. The Company reserves the right to unilaterally amend the Terms of Use, subject to publishing them on the Channels and providing notification in the event of a major change. Users do not have the right to interfere with the Terms of Use. 1) Obligations of the Company Through the Channels, the Company will provide access to Users and will make valuation recommendations regarding the Users' assets; however, it will in no way provide investment advisory services. The Company does not undertake to provide an uninterrupted service, and there may be non-flow and/or interruption in the system arising from either providers or servers. In the event that development is to be carried out, if it will affect the service, the Company will notify the Users and Member Merchants of this situation in advance. 2) Obligations of the User and/or Member Merchant Users are obliged to act in accordance with these rules and to produce content in compliance with the legislation; the legal and criminal liability in each transaction and action shall belong to the User and the Member Merchant, and the User accepts, declares and undertakes that the Company has no liability whatsoever with regard to the said legal and criminal obligations and that it will in no way pay any compensation, and that, should the contrary be the case, the Company's right of recourse is reserved. Users accept and declare that, under Law No. 5846 on Intellectual and Artistic Works (FSEK), they do not and shall in no way infringe the intellectual property right of any third party, nor the intellectual and proprietary rights of the Company on the basis of the Channels that are the subject of these Terms of Use; that, should the contrary be the case, they will immediately terminate the matter and compensate the damage. Users accept and undertake that they will not carry out acts that would damage the personal and commercial reputation of the Company and third parties, that would violate or assault personal rights; that they will act in accordance with the legislation, public order and general moral rules; that they will take the measures required by the legislation and fulfill the procedures; that they will not engage in attitudes and behaviors that are unlawful, that would constitute a crime, that are disturbing, that damage personal rights, that infringe intellectual rights, copyrights, trademark rights and proprietary rights; that, pursuant to the regulations of the Law on the Human Rights and Equality Institution of Turkey concerning the principle of equality and the prohibition of discrimination, they will not provide use of content that would create discrimination based on the grounds of gender, race, color, language, religion, belief, sect, philosophical and political opinion, ethnic origin, wealth, birth, marital status, health condition, disability and age, and that they will not engage in attitudes and behaviors directed toward this. The User accepts that, in the event of the use of all or any part of the Channels for the purpose of corrupting, modifying, or reverse engineering pursuant to FSEK; the attempting to crack the API protocols by means of the reverse engineering method or any different method, and the unauthorized access to parameters such as the API key, API secret key, request headers, client authentication algorithm, or the unauthorized sharing of these parameters with third parties; the use on the Site of automatic programs, robots, spiders, web crawlers, spiders, data mining, data scanning or "screen scraping" software or systems, automated tools or manual processes; the unauthorized access to the data or software of other users; the running of bots as a result of determinations to be made according to various criteria, DDOS attacks and the carrying out of any and all attacks directed toward corrupting, modifying, reducing the existing performance of, or destroying all or part of any and all systems, and of any and all other systems, and other unlawful uses, the Company's right to block the account and its right to compensate its damages are reserved in the case of such uses. Resolution of Disputes Turkish Law shall apply to these Terms of Use, and the Bodrum Courts and Enforcement Offices shall have jurisdiction in the resolution of any and all disputes that arise or may arise.
